Kutak Rock LLP has elected new partners from its attorney ranks in five of the firm’s offices—Atlanta, Denver, Minneapolis, Kansas City and Omaha. The promotions became effective on January 1, 2018.

Thomas Lauth (Atlanta) focuses his practice primarily on public finance matters. For more than 25 years he has represented states, counties, cities, public authorities, hospitals, non-profit and for-profit corporations and limited liability companies, investment banking firms and other financial institutions in a variety of public finance matters as bond counsel, underwriter’s counsel, disclosure counsel, borrower’s counsel, letter of credit bank’s counsel, trustee’s counsel and issuer’s counsel. Mr. Lauth advises clients on a wide variety of business and legal issues, including state constitutional and statutory issues and federal tax and securities issues, primarily related to public finance matters.

Kenneth S. Witt (Denver) is a member of the firm’s Energy and Natural Resources Practice Group and represents energy and technology companies and institutional clients in public offerings, mergers and acquisitions and financing transactions. He works with clients in a number of industries including oil and gas exploration and production and services, cross-border investments, semiconductor technology, encryption, software and information technology. He also serves as lead counsel on a wide variety of sophisticated transactions, including venture capital investments, international finance (including joint ventures, cross-border finance and offshore family offices) and strategic alliances. Ranked “AV” (Preeminent) by Martindale-Hubbell®, Ken is a graduate of Harvard University and Harvard Law School.

Robin E. Stewart (Kansas City) is the founder of Kutak Rock’s eDiscovery Practice group and has pioneered the development of efficient, practical and effective approaches to address the explosion of electronically stored information’s use in modern litigation. Ms. Stewart is recognized as a global expert on electronic discovery, digital evidence and attendant issues. She represents numerous clients in the financial services industry in matters ranging from disputes between and among investors, to assisting clients in overcoming regulatory hurdles to defending clawback claims from receivers and trustees. She also maintains an active commercial litigation practice and has served as national lead trial counsel in dozens of state and federal litigation matters. She has represented clients in numerous class action cases involving antitrust, environmental, product liability, false advertising, consumer protection, Telephone Consumer Protection Act, the Americans with Disabilities Act and a variety of other state and federal claims.

Alain M. Baudry (Minneapolis) is a recognized commercial trial lawyer. He has tried numerous complex commercial court and jury trials in federal and state courts and before arbitration panels. He has extensive experience in complex commercial litigation, representing both plaintiffs and defendants in significant commercial disputes. In 2016 Mr. Baudry successfully resolved a class-action lawsuit on behalf of the Minnesota Timberwolves over their electronic ticketing platform, settled a $7 million insurance coverage dispute on behalf of a major egg producer, tried a lawsuit in Iowa federal district court for the same egg producer involving the unwinding of an $8.9 million construction contract, and was co-lead counsel in a major lender liability dispute in a Houston court trial in December.

Todd Guerrero (Minneapolis) concentrates his practice on the representation of energy companies and utilities in a wide range of business and regulatory matters, including project development, acquisitions, power purchase agreements and related contractual matters, transmission development and interconnection, rate regulation, large energy facility permitting matters, and contested cases before energy regulatory agencies. Mr. Guerrero's practice also includes appellate review, particularly as it relates to energy and administrative agencies.

Andrew J. Whealy (Omaha) focuses his tax credit practice on new markets, historic rehabilitation, low-income and renewable energy tax credits as well as other related state and federal financing products. He also has significant experience structuring secured transactions, commercial financing and real estate lending projects.

Justin D. Young (Omaha) focuses his practice on commercial lending and has experience with a variety of secured transactions, including commercial real estate loans, taxable and tax-exempt equipment financings and multi-family housing projects. In connection therewith, Mr. Young has represented numerous financial institutions in their diverse capacities as lender, letter of credit provider and bond purchaser, among other unique arrangements. Mr. Young also frequently works with lenders, owners and investors in various real estate development matters, including the financing, leasing and disposition of a wide range of commercial, residential and mixed-use projects.
