Ms. Webster is an associate with the Litigation practice group in Kutak Rock LLP’s Kansas City office. She focuses her practice on insurance coverage and commercial litigation, including appeals. Ms. Webster also serves in local organizations, including the Association for Women Lawyers of Greater Kansas City, and as a mentor.

Ms. Webster has been accepted as a member of the Centurions Leadership Program, Class of 2018, at the Greater Kansas City Chamber of Commerce. 

Ms. Webster’s national insurance practice encompasses a broad range of coverage issues and disputes, including:

  • Reviewing and making determinations regarding whether occurrence-based and claims made policies afford coverage for third-party claims;
  • Litigating declaratory judgment actions regarding whether commercial general liability, professional responsibility, excess/umbrella, and personal lines policies afford coverage for third-party claims arising from bodily injury, property damage or wrongful acts;
  • Defending equitable garnishment lawsuits;
  • Defending first-party lawsuits for vexatious refusal to pay and breach of contract arising from commercial property damage claims;
  • Litigating claims for reformation of policies; and
  • Defending bad faith failure to pay lawsuits.

Recent matters:

  • Obtained summary judgment in the United States District Court for the Eastern District of Missouri on breach of contract, vexatious refusal to pay, and bad faith failure to settle claims arising from a property damage claim under a commercial general liability policy.
  • Successfully defending against summary judgment in an equitable garnishment action, and resolving the matter for substantially less than the underlying multimillion-dollar judgment.
  • Drafting an amicus brief filed in the Supreme Court of California addressing a split between courts in the same appellate district.
  • Advising on policy coverage in connection with construction defect litigation, fire losses, and criminal or fraudulent acts.

Ms. Webster’s commercial litigation practice focuses primarily on representing businesses on and defending them against breach of contract, breach of fiduciary duty, and statutory-based claims in the following areas:

  • Employment-related disputes;
  • Health care;
  • Intellectual property disputes; and
  • Commercial foreclosure and receivership.

In connection with her commercial litigation practice, Ms. Webster has been part of the litigation teams responsible for defending a community hospital against hostile efforts to sell it to a for-profit purchaser and obtaining summary judgment on behalf of a health care services provider against an unpaid student intern on claims of public policy-based wrongful discharge and breach of contract.
