Ms. Newberry is a partner in Kutak Rock's Scottsdale office. Her diverse practice encompasses corporate formation and governance matters, taxation, financial services and gift cards/prepaid access, securities, escheat/unclaimed property, and nonprofit organization formation and management. She leads the firm’s state and local tax practice and is chair of its Audit Letter Committee.

Ms. Newberry works with clients with all aspects of tax compliance, including tax strategy, nexus evaluations, audit management, tax litigation, offers in compromise, and voluntary compliance and amnesty programs. She assists numerous companies in managing interactions with the Internal Revenue Service and has worked with clients on tax matters from all 50 states and a number of foreign jurisdictions. Ms. Newberry helps clients to assess and restructure their tax compliance programs to ensure compliance with multistate tax obligations and escheat/unclaimed property requirements, including compliance with gift card reporting obligations for instruments issued in-store or via a web platform.  

Ms. Newberry also works with banks, restaurants, and other retailers on the structuring and compliance functions for prepaid access programs, including gift cards and other closed and open loop forms of prepaid access. She advises her clients regarding the federal regulation of closed and open loop products, including issuance, redemption, reload, and information gathering and retention requirements for consumer and business to business sales.

Ms. Newberry works with nonprofit organizations on all formation issues, including preparation of Forms 1023 and 1024. She advises her nonprofit clients with respect to best practices, including corporate document preparation and advising with respect to board of director issues, financial accountability, governance procedures, auditing issues, for-profit and nonprofit subsidiaries, disqualified persons, conflict of interest procedures, document retention policies, and Form 990 compliance. Ms. Newberry also works with numerous health care and pharmacy entities, advising these clients on corporate planning, taxation, and controlled substance compliance issues.

Ms. Newberry is a sustaining member of the Junior League of Omaha and serves on the fundraising guild boards of Lauritzen Gardens, Child Saving Institute, Omaha Symphony, and Joslyn Castle. She was recently featured in Omaha’s Edge Magazine for her volunteer work in Omaha.

Ms. Newberry is a member of the Board of Directors of Memories for Kids, a Nebraska 501(c)(3) nonprofit organization, dedicated to creating lifelong memories for children who have a parent with stage IV cancer.
