Kutak Rock Successfully Defeats Taxpayer Challenge

Kutak Rock litigators successfully defeated a challenge by taxpayers to the formation of a special metropolitan district. The taxpayers argued the order of the Colorado District Court forming the metropolitan district was null and void because of alleged fraud on the court and for lack of due process.

On March 27, 2014, the Court of Appeals affirmed the arguments of Kutak Rock in deciding the challenge was barred under the Colorado Statute that permitted only the State of Colorado, through the attorney general, to challenge the formation of the metropolitan district. The court also confirmed the order awarding costs to the prevailing parties.
