Ken has successfully represented clients in complex commercial litigation for more than 30 years. Clients receive more than Ken’s decades of experience: they get a committed partner who shoulders their problem as if it was his own. 

A constant component of Ken’s practice focuses on eminent domain. He combines legal expertise in eminent domain and a personal philosophy against its overreach to successfully litigate on behalf of landowners. He has guided many clients through eminent domain matters from their nascent stages through trial and into the appeals process. Ken has represented landowners dating back to takings for Denver International Airport, to actions initiated by the United States Bureau of Reclamation for the construction of a dam, to takings by the Colorado Department of Transportation, E-470 Public Highway Authority, Regional Transportation District, as well as many other governmental and quasi-governmental entities, including urban renewal authorities. Ken also represents municipalities and other governmental and quasi-governmental authorities in the exercise of eminent domain authority. 

Ken has substantial experience in a broad range of complex commercial litigation matters. These include all manner of general contract disputes, real-estate purchase and sale disputes, real-estate development disputes, landlord/tenant disputes, title insurance disputes, Colorado Consumer Protection Act claims and creditor lien and mechanic’s lien litigation. He has represented national, regional and local real estate developers and landowners in commercial litigation and eminent domain representation on a wide variety of development projects, including development and redevelopment of regional shopping mall sites, development of water storage facilities from sand and gravel pits as well as several urban renewal projects. 

Ken is a frequent lecturer at continuing legal education seminars on eminent domain topics, general real estate topics and litigation and trial strategies. Specifically, he has presented many times at the annual eminent domain seminar offered by CLE International in the State of Colorado and has published numerous articles on various topics for such presentations.
