District Court Awards Travel Services Company $500,000

Kutak Rock attorneys Julie Cox and Sam Blatnick of the firm’s Kansas City office obtained a judgment from the U.S. District Court for the District of Kansas in favor of a travel services client, awarding the company more than $500,000 in damages for breach of contract.

On behalf of the client, Kutak Rock filed for breach of contract against Luxury Travel Brokers, Inc. and Timothy Gibson regarding the defendants’ failure to pay for access to frequent flyer miles and credit card reward points. After receiving a judgment finding the defendants breached a verbal contract, Kutak Rock proceeded to try the hotly contested damages case seeking more than $500,000 in damages from the defendants. The defendants claimed no money was owed, arguing the parties had operated as a combined company, during which time they agreed to split profits. After presenting evidence over multiple days, the court ruled in favor of the firm’s client and awarded the company the damages sought.
