Jad Davis, a partner in Kutak Rock’s Irvine and Los Angeles offices, recently authored an article in the October 2014 issue of Storm Water Solutions magazine titled “Changes to EPA’s Construction & Development Point Source Pollution Rule.”

In the article Davis discusses the Environmental Protection Agency’s (EPA) final rule relating to effluent limitation standards for the construction and development point source category and how it is affecting the industry. Davis addresses the numeric limitations the rule imposes and its construction industry group and stakeholder critics. The article also explains the three main changes to the construction and development point source category: the non-numeric limitations and the added definition of the term “infeasible” to provide guidance to permitting authorities; the non-numerical effluent limitations; and withdrawal of the numeric turbidity effluent limitations and monitoring requirements.

Davis focuses his practice on environmental law. He advises clients on a wide range of regulatory compliance and environmental enforcement matters and represents clients in state and federal courts as well as before various state, regional and local agencies in lawsuits alleging an array of soils, water and air contamination.
