Mr. Holwerda’s practice consists primarily of real estate transactions, including acquisitions, dispositions, financing and leasing with a particular emphasis on commercial real estate financing (representing both lenders and borrowers) and office and retail leasing and acquisitions. He also has experience in loan workouts and modifications, lease defaults and lockouts, and trustee’s sales. He has represented REITS, real estate investors, developers and lenders in a range of transactions involving various types of properties, including shopping centers and other retail properties, convenience stores, industrial properties, office buildings and apartment complexes. Mr. Holwerda also has experience in business planning for real estate transactions, including structuring and forming limited liability companies and corporations.

  • Counsel to multibillion-dollar REIT and property owners in all facets of the leasing process for properties nationwide that range in size from small in-line spaces to big-box anchors.
  • Counsel to institutional lenders and private lenders regarding loan defaults, completion of loan workouts and restructuring and with the completion of trustee’s sale and deeds in lieu of foreclosure on collateral property.
  • Counsel to private and institutional lenders and borrowers regarding the drafting and negotiating of loan documents on commercial property.
  • Counsel to receivers, property managers and tenants regarding preparation of new leases, lease modifications, lease extensions and renewals, and in lease defaults and default remedies.
  • Counsel to anchor tenants regarding the preparation and negotiation of retail leases.
