Jeff Makovicka: CRA Could Be Expanded to Bank Guidance

Kutak Rock attorney Jeff Makovicka authored the article “The Other CRA" in the November/December 2017 issue of Nebraska Banker.

In the article Makovicka explains that the Congressional Review Act (CRA) establishes a special set of procedures through which Congress can nullify final regulations issued by a federal agency.  Makovicka reviews  the U.S. Government Accountability Office's legal determination that the federal banking agencies' 2013 Interagency Guidance on Leveraged Lending is a rule subject to the CRA, and opines that this determination has the potential to lead to enhanced congressional review of old and new bank regulator actions, including policy statements.
