Mr. Burns is a partner in Kutak Rock LLP's Denver office. He focuses his practice on real estate and finance matters, and represents commercial lenders, community development entities, developers and other investors in a variety of transactions. Mr. Burns assists a variety of clients throughout the country with complex financial transactions, including those incorporating Federal New Markets Tax Credits, State New Markets Tax Credits, Renewable Energy Tax Credits, Historic Rehabilitation Tax Credits and Low-Income Housing Tax Credits. Mr. Burns also assists various organizations with general corporate matters.

Representative Experience

  • Counsel to a construction lender in loan for the development of multifamily housing projects using Low Income Housing Tax Credits.
  • Served as special counsel assisting nonprofit organizations both in obtaining exemption from federal income tax and during participation in New Markets Tax Credit transactions.
  • Represented community development entities and developers in New Markets Tax Credit transactions which enabled the construction of renewable energy projects, including projects involving solar panels, wind turbines and bio-refineries.
  • Represented tax credit investors and qualified active low-income community businesses as special counsel for the construction of several elderly care and medical facilities using New Markets Tax Credits.
  • Represented developers in transactions combining New Markets and Historic Tax Credits to facilitate the construction of a medical office building and the rehabilitation of an historic theater.
  • Prior to law school, Mr. Burns spent 11 years as an officer in the United States Army, serving in various leadership positions from UH-60 Blackhawk platoon leader in the Balkans to company commander with the 101st Airborne Division during Operation Iraqi Freedom.
