Arkansas General Assembly Passes SB 998 Addressing Enforceability

The Arkansas General Assembly recently adopted a new law that strengthens the enforceability of employee non-compete agreements within the state. The new law, among other things, provides a presumption of reasonableness for a two-year post-termination restricted period and requires courts to reform any otherwise unreasonable restrictions in a non-compete agreement to permit enforceability of the agreement.
