Ms. Berman is a partner in Kutak Rock LLP's Kansas City office. She has a broad commercial practice with an emphasis on complex commercial litigation, insurance and coverage work, landlord-tenant disputes, auto finance, and creditor's rights issues. Ms. Berman counsels a variety of clients during the litigation process, including advising on risk management strategies, conducting mediations and arbitrations, and representing clients through trial and appeal. Ms. Berman serves as the Association of Credit and Collection Professionals (ACA International) Members' Attorney Program State Chair for the State of Missouri. In that capacity, she works with individuals and entities throughout the United States to identify and plan for collection issues that may arise through contacts with the State of Missouri. In addition, Ms. Berman devotes a portion of her time to representing children who are the victims of child abuse and neglect, serving as both a Court Appointed Special Advocate for children and a guardian ad litem.

Representative Experience:

  • Obtained dismissal of a Fair Debt Collection Practices Act action based upon communications with consumer's counsel, which dismissal was affirmed on appeal. Tinsley v. Integrity Financial Partners, 634 F.3d 416 (7th Cir. 2011).
  • Successfully assisted in the representation of a manufacturer in an arbitration related to a $3.6 million contract dispute, which required detailed understanding of complex purchase agreement and construction issues.
  • Has achieved numerous summary judgment awards in representing lenders and financers, winning judgment both on the outstanding balance of notes and on the claims and defenses asserted by the borrowers.
  • After securing a $5 million judgment on a commercial note, advanced the case toward execution and collected substantial sums on behalf of lender.
  • Presenter at Kutak Rock’s annual Kansas City CLE: “Current Issues for In-House Counsel, Protecting Corporate Interests from Inside,” regarding litigation hold issues facing in-house and outside counsels and what measures should be taken to minimize spoliation claims.
