News | July 28, 2015

Kutak Rock attorneys Robert Ahrenholz and Mariza McKee authored an article, "SEC Censures Unregistered EB-5 Broker Activity" in the July 2015 Regional Center Business Journal.

In the article, Ahrenholz and McKee review a recent SEC order resulting in a cease-and-desist proceeding pursuant to Sections 15b and 21C of the Securities and Exchange Act of 1934. Subject to the order are two firms that brokered more than $79 million of investments by foreigners seeking U.S. residency.

Given this and other possible pending actions by the SEC, the authors encourage EB-5 practioners to guard against unregistered broker activities.
